JDM TERMS & CONDITIONS- PURCHASE OF PRODUCTS

 

Please read the terms and conditions below carefully as they set out the terms under which JDM Marketing Limited (“we”, “us” and “our”) makes the products available to you (the "JDM Terms").

 

We have also set out the terms and conditions under which Dima-Service AG (“Dima”) will, pursuant to a separate contract with you, provide certain services to you in connection with the collection, importation and delivery on your behalf of the products ordered by you. Dima are a separate entity to us and you will have entered into separate contracts with us and Dima when you order products from us. You will be entering into a contract with Dima on the terms and conditions set out in paragraph 4 below (the “Dima Terms”).

 

We reserve the right, at our sole discretion, to change, modify, add or delete any part of the JDM Terms and/or the Dima Terms at any time without further notice.

 

 

1.         Price of products

The purchase price of the product that you order is clearly set out in our catalogue. If we have incorrectly listed the purchase price of a product, we shall not be obliged to sell that product to you at the price stated in our catalogue, but shall notify you of the actual price before the item is despatched. Where a product is ordered before it has been released, an estimated purchase price will be given, but the purchase price may be subject to variation, at our sole discretion.

 

 

2.        Availability of products

If we can not make a particular product available to you, for any reason beyond our reasonable control, we shall notify you as soon as is practicable. At our sole discretion, you may be limited to a maximum number of any particular item. Please note that you may only purchase certain products if you are above a certain age.

 

 

3.         sale of the product

Unless and until the product is collected for despatch to the addressee, there shall be no contract between you and us. Prior to the product being despatched, we may refuse to sell the product to the addressee for any reason whatsoever. At the moment that the product is despatched, a contract will become effective between you and us for the sale of the product and you will be charged for the product. You will own the product once it has been despatched by Dima to the addressee. Ownership of the product will therefore pass to you in Switzerland as the product is despatched in Switzerland and you or the addressee will be the importer of the product into the country of delivery.

 

 

 

4.         Collection, import and delivery by Dima on your behalf

When you purchase a product from us, we will introduce you to Dima so that they may collect, import and deliver the product on your behalf.

 

In placing your order, you authorise us to empower Dima to act as your or the addressee's direct representative on the import declaration (in accordance with Commission Regulation (EEC) 2913/92, Article 5).

 

A separate contract will also become effective between you and Dima for the collection, import and delivery of the product as set out in this paragraph 4. At the time that the product is despatched, a contract will be made between you and Dima for the provision of the delivery services. In agreeing to these Dima Terms you consent to the commencement of the delivery services before your standard right to cancel expires. This consent does not affect your rights to cancel under the JDM Terms (details of which are set out in Paragraph 5 below), as the consent relates only to the delivery services provided by Dima to you.

 

Dima shall deliver the product via Parcelnet or an equivalent service to the address specified by you on the completed order form. If, for any reason beyond Dima's reasonable control, Dima is unable to collect, import or deliver a particular product on your behalf, you will be notified as soon as is practicable.

 

Any charges made by Dima to you for the delivery services are included in the purchase price as set out in our catalogue, including any applicable postal costs. Notwithstanding the previous sentence, Dima has no control over any additional charges that may be incurred in connection with customs clearance regarding the product. As the recipient of goods from a third country, you are the importer. Dima will make arrangements for customs clearance and pay any charges on your behalf.

 

Dima shall only deliver products to England, Scotland, Wales and Northern Ireland. All deliveries are by Parcelnet or an equivlalent service once the product is within the United Kingdom. Dima will attempt to secure posting within 30 days of the date of your order but shall not be liable for any loss occasioned by delay in posting which has arisen out of any cause beyond its control.

 

 

Dima's liability to you in connection with its collection, import and delivery services shall be limited to the retail price of the product, save that nothing in the Dima Terms shall exclude or limit Dima's liability for personal injury or death caused by our negligence or for the tort of deceit.

 

If any part of the Dima Terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Dima Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

 

The Dima Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes under or in connection with the Dima Terms shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

5.        Cancellations and returns

You have the right to cancel your order up to 28 working days from the day following the delivery by calling our customer services department on the following telephone number: 0344-848-2030

 

If the product has already been despatched at the date of receipt of your cancellation of the order you must return the product to us and, provided always that the product remains sealed and un-opened, we will credit your credit or debit card (as applicable) with the price of the product within 30 days beginning with the day on which notice of cancellation was given.

 

If you do not return the product within 21 days of your cancellation, we may charge you in respect of the cost of recovering the product. If you do not return the product or fail to make it available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the product and you will be charged for your order at the purchase price.

 

If for any reason you would like to return a product within one year unless otherwise specified in the offer, please return the package via Royal Mail and you will be refunded for the cost of the product.

 

(i)         Stipulate your reason for return on the despatch note;

(ii)        Include the product, which must be sealed and un-opened, and the despatch   note in your package; and

(iii)       Address your return package to:

Nothing in this Clause 5 shall affect your statutory rights.

 

 

6.         METHOD OF Payment

You can pay for your product by any Visa or Mastercard credit card, or Maestro or Delta debit card. Authority for payment must be provided by you at the time of order.

 

Payment is taken at the point of despatch of the product. Please ensure that the expiry date of your payment card is later than the anticipated despatch date of your order. If the payment card has expired we will be unable to take payment and fulfil your order.

We are not responsible for typographical errors. If any part of these JDM Terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining JDM Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

 

These JDM Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes under or in connection with the JDM Terms shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
